Don't give up, take the exam. You never feel completely prepared and cannot
loose by making your best effort.

July Bar has 76% pass rate for first time ABA CA law school grads. February has much lower pass rate. Non-ABA has 23% pass rate in July. Repeaters have approx 16% and non-ABA repeaters 6% pass rate. These are all approximations I got off the web. I cannot vouch for accuracy.

This is what I have heard: the February exam may SEEM like it is easier because the pool of applicants has more repeat takers, but the questions that they give on the February exam (essay and MBE) tend to be more experimental and out of the ordinary. Because the questions are more experimental, the test itself may be more difficult but your analysis doesn't need to be perfect to get a good score. For example, this past Feburary they tested California Evidence for the first time. On the other hand, the July exam has more straight forward questions and a more standardized pool of applicants, so they expect a spot-on analysis.

As for whether you should take the test, I don't think you should base your decision on whether the Feb or July administration is going to be easier or not. They are basically equal, in my opinion. It's mainly up to you and how prepared you think you will be and how much time you want to waste on this thing. Good luck in your decision!

I took both July 2008 and Feb 2009, and found the exam harder in February. My score went down by about 50 points, but still was in second read both times.

The scaling formula was harder in Feb for some reason. My raw scores from Feb using July scoring calculation would have yielded the same score, 1432, off by a mere tenths of a point between the two.

I agree that more unusual stuff and more crossovers occur in Feb than July. Never hurts to give it a shot and see how you do!
