I took it in October, but could not use my laptop to type the essays. The ExamSoft program needed to access the .msi installer file, but my wireless client was not cooperating. It was very unsettling, to the say the least.

I had complied with all of the installation/preparation requirements, and relied on the claim that internet access would not be required during the morning of the exam. I think I should have saved the installation program to my hard drive. Maybe I clicked "run" instead of "save", I'm not sure.

The actual exam was extremely tough. Doing 100 MBE questions in 3 hours was more difficult than I thought. For me, it was barely enough time to read the questions and evaluate each answer choice. I think I may have spent too much time early on agonizing over which of the two remaining answer choices to pick on some of the questions. As it was at the :30 second mark, I had to bubble in the answers to the six questions that I had remaining. I feel confident about most of the questions that I did answer, although I know that a raw score of 75 will be hard to get out of 94 questions answered.

For those wondering, FYLS do not get any breaks. The MBE questions were tougher than any of the prep questions, that I studied with at least. What made them especially tough is that the questions involving a main fact pattern were not clustered together. Because they were spread throughout the exam, I would have to re-read the main facts. I wish I could have just focused on the changed facts and the new call of the question. I would have saved alot of time.

Four essays in four hours seemed doable, but I had difficulty managing my time with a defamation question and a Torts racehorse question.

I know that I am going to have to re-take the exam. I am disappointed, because I really knew the legal rules. But, it is apparent to me now that I will have to practice more MBEs and do alot more practice essays in order to be successful and join the 18% that pass this exam.

I agree with you that the MCQs were very challenging. Cheer up because you might be underestimating how well you did.

A study group is an excellent idea. I didn't have that luxury. That said, if you can find some people who will not just ride on your coat-tails...then go for it!

BTW--Scrivener5 is my screen name that refers to the fact that I actually hand-wrote the exam. Should I be fortunate enough to clear this hurdle, then I will absolutely use a laptop on the full California bar exam!

You are absolutely, 100% correct about the realism aspect. But, let's face it--this exam...like most bar exams...is a mind trip. You just have to be grounded. You must not give in to weakness. You must stay focused. You must be confident. You must be calm, cool, collected, in control, and in full command of all of your faculties.

Sometimes, a motivational speech can reach that inner part of your soul and inspire you to greatness!

(Just sayin'...)

It seems as though people are asking about this distance learning avenue to the J.D., lately. I guess it is because the world is global, technology is instantaneous, and the old models are old and tired. Cyberspace is the present, not the future.

That said, I wish the best for all who took the FYLSE on October 27th. Today, I believe, candidates for the full Bar get their results. Best wishes to you, too!

i wrote. it was straight frwrd buddy. no suprizez. follow the calls and dont panic... cntrctz was the tricky one and crim was really long! Torts 1 was neg/int's 2 was def/iop's... mbe's wer close to finz but shorter... flemingz is a distractor cuz he makes he derives his Q's starting with the Answers so i would avoid his review for the MBE's... i ran out of time on the last essay though but i got all my issues/points in... good luck!

October 2009 FYLSE California Baby Bar Exam

 

These are the questions from the October 2009 Baby Bar Exam (as I remember them).  Please provide more details that you remember.

 

I completed the essays in numerical order.  I have supplied my own titles:

 

Essay One: The Political Rally

 

The facts were that, at political rally attended by 1,000 people, the organizer at the event (in support for a challenger to the mayor) made defamatory comments about the wife of the current mayor.  Based on "largely false" information he heard from a notorious gossip, he told the crowd that the mayor's wife was a snob and a cutthroat who blocked her personal friend's membership to a private women's club.  The mayor's wife had actually supported her friend's membership. The mayor's wife had appeared in public for the first time two days before the event.  The call of the question asked (1.) about the the claims of mayor's wife and (2.)the organizer's defenses.

 

Essay Two: The Laptop Theft

 

In trying to recover a gambling debt, a principal sent an email to his agent friend instructing her to recover the debtor's laptop from the debtor's house.  The principal led the agent to believe that the laptop belonged to the principal.  In the email, the principal told her where to find the key under the doormat to the debtor's house. 

 

The email was intercepted by a third party, without knowledge of the others.  When the agent arrived at the house, the door was open and the third party was ransacking the house.  The agent entered through the open door and startled the third party.  The third party slipped and fell,  banged his head on a table, and ran away. 

 

The agent searched the house, found the laptop, and decided she wanted the laptop for herself. She put the laptop in her purse.  The agent called the police.  When the police arrived, the agent said that the third party stole the laptop.  When  the police went to the third party's house, they found him dead.

 

The call of the question asked us to discuss the crimes and the defenses.

 

Essay Three:  The Luxury Boat

 

A luxury boat company sent an unsolicited mailing to a prospective customer for an all-expenses paid trip to a hotel next to where a luxury boat was being offered for sale.  The customer came and looked at the boat.  The salesman claimed that the boat was "state of the art" and at the best available price.  He gave her a form to which he had written the name of the boat in the blank.  He wrote her name on the form as well.  In red italics above the customer signature line, there was a statement such that "This offer is made with the understanding that it is accepted only  after the Luxury Boat company approves the sale."  

 

The customer took the unsigned form home.  A week later, she searched the internet and found out that the boat was not the best price.  She still decided to sign the form and she faxed it back to the company.  Another week later, she did more research and found out that the boat was a discontinued model.  She faxed a revocation.  The same day she received in the mail the form she had signed.  It was stamped "approved" by the company.

 

The call of the question asked what were the Company's claims against her and on what theories. 

 

Question 4:  The Loud and Violent Teen

 

A minor had gotten into trouble for disruptive behavior in school.  A psychologist hired by the school assessed the minor and determined that he had a 90% chance of committing violence on someone in the future.  The parents ignored the warning and sent the minor to stay with his uncle.

 

At the uncle's house, the minor loudly played his guitar.  The noise disturbed a neighbor who was a therapist counseling patients in his home.  The therapist complained to the uncle.  The uncle told the minor to lower the volume.  The uncle had to leave the house one day and told the minor to keep down the guitar's volume.  When the uncle left the house one day, the minor cranked up the volume.  The therapist came over and asked the minor to turn it down.  The minor told him off.

 

As the therapist was leaving the minor threw a large heavy rock at him.  The rock missed the therapist but hit a woman walking by.  The woman sustained serious and permanent injuries.

 

The call of the question asked for:  (1) The therapist's actions against minor, (2) The therapist's actions against the uncle, (3) The woman's actions against the minor, and (4) the woman's actions against the minor's parents.

Why arnt you guys discussing the actual test... enough with the you tube clips... my school has a 2/3 pass rate... so i am not worried. As for the rest of you having to contend with the average 18 percent, well i recommend suing the bar. :P
Seriously though, we need to get the cali ledgeslator to make ABA students take the exam as well. I predict if that ever happened the powers at the ABA schools would force the Cali bar people to make the test fair... Studies have been done having ABA kids take the baby bar, and they did hardly any better if not worse... But i digress, I hope the pass rate is higher then usual, with two tort essays this past exam i may get my wish. :-)

Oh spelling is overrated. I was writing it on the fly before church. Didn't even bother spell checking it, its not like it matters, LOL. Besides spelling doesnt count on the baby bar. If you spend your time worrying about such things you will never pass. But I guess thats why my school has the highest pass rate, we worry about the imporant things. So where do you go, Peoples College of Law. :P
(OH and FYI Peoples has the worse pass rate in the world, google them, you will get a laugh. :P They are the reason that everyone thinks we unaccredited law students are dummies, well that and my poor spelling... :P See I can laugh at myself too. ;-)
Well now back the point, how did you guys feel about the exam. My fellow students said it was tough but fair. They said the multiple choice was easier then past test's that have been given. (We did a lot of practice tests which included former exams.
Oh and what did you guys think of the essays? My class again thought they were easier then in the past, no real cross over.
Oh and this will make your day, some moron from another school was arguing promissory estoppel on the contracts essay when there was clear consideration. Its people like that make it easier for the rest of us. Poor, poor, souls. :-) (Oh and I would spell check this but this silly sight has no spell check and it wont let you copy and paste so deal with the poor spelling and enjoy my long post. :-)

I would like to feel sorry for tiger, but he is not repentent for what he did. In fact he was trying to cover it up when he made that famous phone call that the media has reported.
I think he is only sorry he was caught. From the sounds of it he was involved with multiple woman. Quite sad really, married too a blonde thats a 10, and he is cheating cocktail waitresses. What in the world! Sorry I am ranting.
Now back to the Baby Bar... Like how does everyone else feel about the exam? Like what is everyones plan B if they flunk?
Oh and did everyone get finish the exam? I barely got through it on the essay porition, didnt get to spell check it like i wanted. But I the multiple choice was easy, finished with 5 minutes to spare, and that was with looking at my watch after every question...

Hi Sherminator,

I really thought that my law school prepared us well for what we faced on October 27th.  In fact, on October 26th, our Dean specifically told us to pay careful attention to the call of the question.  He showed us the June 2009 FYLSE California Baby Bar exam.  There was a trick question:  A convoluted fact pattern (but very specific call of the question) that was designed to punish those who started writing without first carefully reading!

I am thankful that I attend a top-notch distance education law school!

I am glad your prof did a great job and told you rule #1. Follow the call of the question! It sounds like your in good hands. I worry about the last contracts question because the call addressed breach, I managed to get through just about everything, however was only able to partially address that... That is the only real thing that scares me on the essays.
As for how good your school is well just look up their stats over the last ten years on the BB. You can feel as good as you want about the instruction, but if they only have say a 16% pass rate, well then your up the creek so to speak. I am not trying to be harsh, just trying to prepare you for the worst. I am not saying you can't beat the odds, I am just saying its best to be well informed. As my school has the highest pass rate in the state, I am not as worried, but then again one never knows. This test is designed to fail you! The graders admit as much. In fact, I am told they go in with the assumption that your paper is a 60% to 65% and they have to justify giving you a higher grade.
Oh and be glad your not going to a place like Peoples College of Law. Again, they have the lowest pass rate in the state. To put this in perspective if you wind up their, you have a better chance becoming a lawyer by collecting spare change from you counch and bribing the chief justice with it. :P

It seems odd to use the schools as an indicator of how well you may or not have done, especially when you consider the best of the best still avg. under 30%.

By defintion a majority of the people taking this test are going to "distance" or "correspondence" schools so they are more likely than not relying on their own ability to learn and pass the test not that of a professor.

I am currently attending a DLS that has consisitently been in the top percentile, but in my preparation for the FYLSE my professors were a VERY small factor.

Ummm Speak for your self about the best school having a pass rate of only 30%... My school has an average around 66% more or less... In fact one year we had a 93% pass rate! And yes this is the baby bar. Like I said, my school has the highest pass rates.
That said, for those of your that go to a school with a pass rate in the teens, well things could be worse.
However, I can tell you one such fellow I know who failed. There was an african american man in front of me in line for the test. The fellow didnt seem to realize that digital clocks were banned, well the young man would not give up his digital clock when he was told he could not have it, as a result i saw him tackled by this old white man. It was quite the site. Kinda sad really, felt bad for him. But he should have read the rules! So there is one fail for you. :-)
So guys, when you add up the fools that didnt read the instructions on the multiple choice, or the ones that didnt read the call, or even the people that wrote immediately without prewriting, well you take out a lot of the failures. That sad, if you did not do those things the odds improve. :-)
