I've heard that your only real chance is if you are within 2 pts, but since you can appeal if you are within 9 pts, I say go for it. The worst that can happen is you have to retake the test.

A person I know failed a bar exam by .10 of a point. Yes, 1/10th of a point. She appealed and LOST. The state said: "we have to draw a line somewhere."

Well, I wish you weren't in this situation. Truly.

But you may have more ground to appeal this year than others. If you will remember, the lights went out near the end of the essay portion of the exam. Bradley Skolnik, the director, gave all applicants (I believe) 10 additional minutes because of the disturbance. If you are close to passing, I would argue that the additional time unfairly prejudiced you because you had correctly budgeted your time (or something like that).

Hi,

I failed the exam in Feb. 2011. I wanted to appeal. After long research, I was told that there is no point of appealing. They said that the BOLE says that they have to draw line at some point. So, I quit the appeal. Studied and passed. So, if I were you do not waste your time. Put your energy study and you will pass in Feb. Sorry, this may sound cruel but it is the reakity.

I've known two people to appeal and have their appeals granted. I don't think it would hurt at any rate.

I just took the February 2015 Indiana bar and missed passing by six points. I was just wondering if anyone else has had any appeal experience in regards to the Indiana bar, since this forum was posted.

Just wanted to let anyone who is interested in the Indiana appeal process know that I missed passing the February 2015 Indiana bar by 6 points. My appeal was unsuccessful.

if anyone has any questions about the Indiana appeals process, ill try to answer them and check in everyone once in a while. Good luck to everyone in July see you there :/

Sorry to hear that and Best of Luck this next round.

The appeals process seems like a big joke unless you are 1 or 2 points away - at least from what I experienced in my state.

Just wondering if the IN board of law examiners said you gained any points with your appeal or just flat out told you it was a no? I failed the July 2015 by one point and am appealing since it only requires a one page form to be sent in. Worth a try....

The form says there is no adjustment of points, just a review and decision. Based on that, the review could be more holistic/subjective than the original grading or remain answer-key heavy/objective. But who knows, really? I missed by two points and am requesting a review. No reason not to.

Honestly, you will likely get a partial approval where you bump up a bit (but still shy of what you need) its all a scam. This part of the scam keeps lawyers in business who only do appeals. Its still just another piece of the bigger scam.

Trust me, I have know lots of people to do this. You want to pass next time? FOCUS ON THE MBE ALONE IN PREP!!!!!!!!!!! No joke. ONLY the MBE. Sounds crazy but you already did prep with the essays. Trust me on this. A 150 or above MBE will carry you on the essays, plus once you know the law that good you suddenly end up doing better on the essays anyways (even if you forget state specific stuff) you still do better.

Do only 5 at a time, MEMORIZE the answers. When writing the answers pregrade write AN ESSAY ON WHY that is it (a short one like two paragraphs long) and then COMPARE to the model explanation in the book or online program (only use ones that offer this, the rest are useless crap). Do this for BOTH right AND wrong answers.

You will pass if you do this.
You wont win the appeal. You can't, stop the bullshit.
Do this right. Just do it.

My thoughts are with you. I am in the same situation. I got my results today and failed by one point. I too have initiated an appeal. Do you know how long it might take to receive a response? I have read through the relevant rule and I have done some searching, but I haven't found any timeline. Fingers are crossed, as it will be a real financial struggle for me to take the exam again.

If you are more than 5 points off, don't bother

If you are less than 5 points, do it, BUT use a company (costs money but worth it)
Its a snowball chance, why make it worse by not paying for it?

I am responding to the above comment. Could you please clarify what you mean by "use a company"? The relevant Indiana rule specifically states that no other documentation can be submitted other than the Request for Review form that is provided on their website.

As of today, I haven't heard anything regarding my appeal. The last information I received was the message posted to the BLE site where they stated that there is no time-table for when the appeals will be completed.

you get a breakdown of your both MPT and each of the Indiana Essay, but the appeal is holistic. They either approve you or don't. (I failed by 3 points, appeal was unsuccessful). This whole Georgia thing has me thinking though.

Because I failed by 3 points, and somehow had a 1 on one of my MPTs when I wrote 4 pages and got a 5 on the other. Even a 2 on that MPT would have passed me, another 5 would have had it be with a very wide margin. I'm also barred in another state, so more than capable of passing and likely will this time.

GA is relevant because this is the second time in as many years that a state has revealed they have improper scoring. (Nebraska being the first, telling people they passed when they failed). There is no audit process for the BLE. Any other profession would be aghast at this.

But I get it, you're a troll.

The essays are very subjective, and the MPT is only a small margin more objective. That's why we have to emphasize the MBE in our prep. You are completely correct in criticizing how the essays are graded, it's a crap shoot. For example, California calibrates three times, most states calibrate only once. Calibration is where they gather the graders together, go over the grading standards, and they grade an identical essay, trying to get all the grades the same. California calibrates prior to grading, one third of the way through, and finally two thirds of the way through the essays. They did a study that found grades still varied by as much as 20%. Think about that for a moment, if your cutoff score is 132, you could get a 112 or a 152 based solely on luck, and that's the state that calibrates the most!

My two cents if file the appeal and get ready to take it again. You have proved you have what is needed to pass. Sorry, I know it's not fair.
