What is the difference between a Subpoena Duces Tecum and a Deposition Subpoena for Production of Business Records?
Both involve requesting production of documents from a non-party, and I know that a Deposition Subpoena can be used strictly for production of documents and does not actually entail a deposition where the attorney asks questions. That said, I'm struggling to discern the difference between them. Is it that the former requires the party to appear in court whereas the latter simply requires the documents to be produced at a specific place and time (outside of court)? Any feedback is much appreciated.
