COLORADO BAR EXAM DISTINCTIONS — ONE-PAGE CHEAT SHEET
Condensed companion to the Colorado Bar Exam Distinctions long outline.
Format: Colorado is a UBE state, so almost everything tested is national law and the items below are where Colorado actually departs from the MBE/majority rules. On the MEE you apply general/Restatement/UPC law unless the call names the jurisdiction, so use this sheet for issue-spotting Colorado practice points rather than for drafting MEE answers. The biggest real distinctions to flag: common-law marriage, the full UPC estate rules, the public-trustee foreclosure system, and the 50%-bar/several-only/damages-cap tort package.
1. EXAM FORMAT
UBE jurisdiction (MBE 200 MC + MEE six 30-min essays + MPT two 90-min tasks, 400-point scale) · minimum passing score 270 (lowered from 276 effective Feb. 2023; older materials wrongly say 276) · scores portable in and out within the transfer window · MEE graded on general/majority law — do NOT volunteer "in Colorado" distinctions unless the call names the jurisdiction · MPRE required separately.
2. CIVIL PROCEDURE
State courts apply the Colorado Rules of Civil Procedure (C.R.C.P.), patterned on the FRCP but distinct · simplified-procedure Rule 16.1 auto-applies to smaller money-damages cases and sharply limits discovery unless a party opts out · District Courts (general) and County Courts (limited) · unique Water Courts have exclusive jurisdiction over water rights.
3. STATUTES OF LIMITATIONS
General tort 2 yr · motor-vehicle injury 3 yr (classic trap — instinct is one PI period) · most contracts 6 yr · UCC/warranty 4 yr · fraud 3 yr · defamation 1 yr · wrongful death 2 yr · strong discovery-rule overlay defers accrual until plaintiff knew or should have known.
4. EVIDENCE
Colorado Rules of Evidence (C.R.E.) mirror the FRE section-for-section, so FRE knowledge transfers · key divergence: Colorado recognizes a statutory physician-patient privilege held by the patient (federal courts do not) · plus a rape-shield statute (alongside C.R.E. 412) and psychotherapist-patient privilege · differences are at the margins and rarely tested on the MEE, which grades on the FRE.
5. FAMILY LAW
No-fault, equitable-distribution (NOT community property), UMDA-based · sole ground is "irretrievably broken"; fault generally not considered in property or maintenance · divides marital property equitably (not necessarily equally); separate property (pre-marital, gifts, inheritance) excluded but its increase in value during marriage is marital · statutory advisory maintenance guidelines keyed to income and marriage length · Colorado still recognizes common-law marriage = mutual agreement to be married + holding out; no license/ceremony needed (2021 refinement); ended only by formal dissolution.
6. WILLS, TRUSTS & ESTATES
Full Uniform Probate Code state — default to UPC rules on any Colorado question. A will is valid with 2 witnesses OR notarization (the UPC notarized-will alternative). Holographic wills are valid where the signature and material portions are in the testator's handwriting, even without witnesses. The harmless-error/dispensing power (UPC 2-503) can probate a defectively executed document on clear-and-convincing evidence of testamentary intent. The elective share uses the augmented-estate sliding scale that grows with marriage length, reaching up to 50% after a 15-year marriage (NOT the flat one-third many states use). In intestacy the surviving spouse takes the entire estate when all of the decedent's descendants are also descendants of that spouse. Wiki entries do not have inline comments.
