NEBRASKA BAR EXAM DISTINCTIONS — ONE-PAGE CHEAT SHEET

Snapshot: Nebraska is a UBE jurisdiction, so the exam tests national majority law—these distinctions matter chiefly for practice and the rare localized fact pattern. The headline departures from the national defaults are the four-year tort limitations period, modified 50% ("less than") comparative negligence, the absence of dram-shop liability, a notice recording act, a UPC estates regime that still imposes a county inheritance tax, and a deed-of-trust path to nonjudicial foreclosure.

1. EXAM FORMAT

UBE state · MBE/MEE/MPT weighted 50/30/20 · minimum passing score 270 (out of 400)—on the high end · score transferable to/from other UBE jurisdictions within the window · plus MPRE and character/fitness · admission on motion available · no separate state-law essay · because it is UBE, essays are graded on national majority law—do not write Nebraska-specific rules unless a question localizes.

2. CIVIL PROCEDURE

Tort/negligence SOL four years (§25-207) · written contract five years (§25-205), oral 4 yrs · professional negligence/med-mal 2 yrs with discovery rule, capped by a 10-year statute of repose · defamation 1 yr · fraud 4 yrs from discovery · action commences by filing · district courts general jurisdiction, county courts handle smaller civil + probate · long-arm (§25-536) reaches the due-process limit · venue where a defendant resides or the cause arose.

3. EVIDENCE

Own Nebraska Evidence Rules (§§27-101 et seq.), FRE-parallel in numbering and substance · expert admissibility under Daubert/Schafersman reliability-gatekeeping (state adopted Daubert) · statutory physician-patient privilege with no FRE analog · spousal, clergy, attorney-client privileges statutory · state rules govern in state court, FRE in federal court.

4. FAMILY LAW

No-fault: ground is the marriage is irretrievably broken; fault largely irrelevant to grant and support · equitable distribution (not community property)—marital estate divided justly, commonly one-third to one-half, not necessarily equal · premarital/gift/inheritance property generally nonmarital but commingling can convert it · Nebraska Child Support Guidelines (income shares) · alimony on statutory factors (circumstances, marriage duration, contributions).

5. WILLS / TRUSTS / ESTATES

UPC state (ch. 30) + Nebraska Uniform Trust Code · valid will = writing + testator's signature (or by another at the testator's direction in conscious presence) + two witnesses · holographic wills RECOGNIZED (signature + material portions in testator's hand)—tracks the UPC · self-proving affidavits allowed · sliding-scale augmented-estate elective share rising with marriage length up to ~one-half · UPC intestacy with descendants taking by representation · probate homestead/exempt-property/family allowances · distinctive county-level INHERITANCE TAX—rates by beneficiary class (close relatives light, remote heavy), still in force where most states have repealed.

6. REAL PROPERTY

Notice recording act (§76-238)—later BFP without notice wins even without recording first · adverse possession 10 years (§25-202), actual/open/notorious/exclusive/continuous/hostile under claim of right · modest homestead exemption (§40-101) · mortgages foreclosed judicially with statutory redemption · deeds of trust under the Nebraska Trust Deeds Act allow nonjudicial power-of-sale foreclosure with generally no post-sale redemption—instrument choice drives the process.

7. TORTS

Modified comparative negligence — 50% / "less-than" bar (§25-21,185.09): plaintiff recovers only if fault is LESS THAN the defendants'—exactly 50% BARS recovery (stricter than the 51% states) · joint-and-several liability largely abolished—several liability is the default, defendants pay their proportionate share (§25-21,185.10) · NO dram-shop / social-host liability at common law—target the drinker, not the server · medical-malpractice total-damages cap under the Hospital-Medical Liability Act for qualified providers · governmental liability capped by the tort claims acts.

8. CONTRACTS / UCC

UCC enacted—sales, negotiable instruments, secured transactions all uniform · standard Statute of Frauds (§36-202 et seq.): land, one-year, suretyship, marriage consideration, goods ≥$500 · essentially no Nebraska departures—apply majority/Restatement (Second)/UCC straight · Article 9 filing with the Secretary of State.

9. BUSINESS ENTITIES

Corporations under the Nebraska Model Business Corporation Act (ch. 21)—substantially MBCA · LLCs under the Nebraska Uniform LLC Act (RULLCA) · partnerships under RUPA · Nebraska law largely coincides with the uniform acts tested on the MEE · confirm whether an existing LLC was formed under the older or current act—default terms differ.

10. PROFESSIONAL RESPONSIBILITY
