HOW TO ACTUALLY STUDY FOR THE BAR
Why Most Bar Study Fails (and What Actually Works)
The single biggest mistake bar takers make is confusing familiarity with knowledge. Re-reading an outline until it feels comfortable produces the warm sensation of mastery without the ability to recall and apply the rule cold, under time pressure, when no outline is in front of you. The bar exam never tests recognition the way your highlighter does. It tests retrieval and application. So your study method has to train the exact skill the exam measures: pulling a rule out of memory and using it on a new fact pattern.
Everything below is built on two findings from cognitive science that have survived decades of replication: the testing effect (retrieving information strengthens memory far more than reviewing it) and the spacing effect (information reviewed at expanding intervals sticks dramatically longer than information crammed). If you internalize only those two ideas, you will out-study most of your cohort.
Active Recall vs. Passive Review
Passive review is reading, highlighting, watching lectures, and recopying notes. It feels productive because it is easy and fluent. Active recall is closing the book and forcing your brain to produce the answer—then checking. Active recall is harder, slower, and far more effective. The discomfort is the signal that learning is happening.
Practical conversions you can make today:
- Instead of re-reading the negligence outline, close it and write out the prima facie elements from memory, then compare.
- Instead of highlighting a rule, turn it into a question on a flashcard: “What are the requirements for a valid inter vivos gift?”
- After a lecture, spend ten minutes writing down everything you remember before looking at your notes. The gaps you find are your real study list.
Spaced Repetition: How to Actually Schedule It
Spacing means revisiting material right before you would otherwise forget it. Each successful recall pushes the next review further out. You do not need fancy software, though tools like Anki automate the math. A workable manual schedule for a freshly learned topic:

The key discipline: once you recall something correctly, do not keep re-reviewing it on a daily basis. Let it rest and spend that time on weaker material. Your review queue should always be biased toward what you keep getting wrong.
Your Study Materials, In Sequence
Each material has one job. Using them in the wrong order wastes weeks.
- The full outline / rule book — your reference library. Use it to understand a rule the first time and to look things up when a practice answer confuses you. Do not try to memorize from it; it is too dense.
- One-sheets (condensed outlines) — one page per subject capturing the high-frequency rules in your own words. These are your memorization documents. Build them yourself; the act of compressing the full outline into a page is itself powerful learning.
- Flashcards — your spaced-repetition engine for discrete, atomized rules and elements. Best for “list the elements” and “define the standard” cards. Avoid cards that are paragraphs long.
- Attack outlines — short, ordered checklists of how to approach an essay in a subject (e.g., for a Con Law question: state action → level of scrutiny → apply). These train issue-spotting and organization, not raw memorization.
- Practice questions — the proving ground where you test whether the rules are actually retrievable and applicable.
The natural sequence for any subject: read the full outline once for understanding → build your one-sheet → make flashcards from the one-sheet → drill flashcards with spacing → do practice questions → refine your attack outline from the mistakes you make.
Interleaving: Mix Your Subjects
Studying one subject to exhaustion before moving on (“blocking”) feels organized but produces fragile memory. Interleaving—mixing subjects within a study block—forces your brain to first identify which body of law applies before retrieving the rule, which is exactly what the exam demands. After your first pass through a subject, never do a 50-question practice set in a single subject again. Do mixed sets. The lower scores you initially see on mixed sets reflect harder, more realistic practice, not worse learning.
How to Memorize 400+ Rules Without Drowning
The volume is real, but you do not memorize 400 unrelated facts. You memorize a few dozen structures, each holding several rules.
- Chunk. Group related rules under a parent concept. The hearsay exceptions are not 25 separate facts; they cluster (statements about state of mind, records, statements against interest, and so on). Learn the clusters, then the members.
- Mnemonics. Use acronyms for element lists you must reproduce verbatim—the classic MR. DARN for non-freehold issues, or your own invented ones. Self-made mnemonics outperform borrowed ones because building them is itself an act of recall.
- Lean on the testing effect. Every time you successfully retrieve a rule, you strengthen it more than three re-readings would. Quiz, don’t re-read.
- Tie rules to fact patterns. A rule memorized in the abstract is hard to apply. A rule attached to a memorable hypothetical (“the case where the landlord changed the locks”) comes with its own application instructions.
- Prioritize by frequency. Not all rules are tested equally. Spend disproportionate time on high-frequency topics and accept thinner coverage of rare ones. Perfect coverage of everything is neither possible nor necessary—you are aiming to pass, not to score 100%.
Practice-Testing the Right Way
Practice questions are not a final exam to be saved for the end. They are your primary learning tool from week one. The protocol that compounds fastest:
- Do the question under realistic time pressure.
- Grade honestly, then read the explanation for every answer—including the ones you got right but guessed.
- For each miss, write one sentence: was it a knowledge gap, a misread fact, or a trap you fell for? Patterns in that log tell you what to fix.
- Convert recurring misses into flashcards and feed them back into your spaced queue.
For essays, write at least some in full. Outlining essays is useful, but the bar tests written communication under time, and that is a separate muscle from knowing the law.
Common Mistakes to Avoid
- Rewatching lectures instead of recalling. Lectures are the lowest-yield hour you can spend after the first pass.
- Endless outlining without testing. If you have not done practice questions this week, you are not studying the exam.
- Saving practice questions “until you’re ready.” You get ready by doing them.
- Studying only your strong subjects because the scores feel good. Bias toward your weak spots.
- Cramming the night before. It crowds out sleep, which is when memory consolidates.

Adjust the volume to your timeline, but keep the shape: new material early in the week, spaced review and mixed practice throughout, full rest built in. Consistency beats heroics. A steady, test-heavy eight hours a day will carry you further than a frantic fourteen spent re-reading.
Study the way the exam tests: retrieve, apply, space, and repeat. Comfort is not the goal—recall is.
